How bad is that Health Care bill Nancy Pelosi is trying to ram down your throat?

Purchase a $15,000 health insurance plan or GO TO JAIL.  This is unbelievable.

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said:  “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail.  It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

Criminal penalties

Prosecution is authorized under the Code for a variety of offenses.  Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties.  The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration.  Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates.  Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

This is all about control over your lives.  How can the government force you to purchase a health care plan?  Is this even Constitutional?  Under this monstrosity of a health care plan, you either purchase a plan force on you by the government, or you go to jail and pay a $250,000 fine.  Having no health care insurance is now a crime, a felony?

This monster has been taking too many botox shots to the head.  Hey you folks living on the streets in San Francisco, Nutty Nancy the Nanny is gonna put you in Jail unless you come up with some cash to pay for her retirement fund.

How does this effect Hawai’i.  Well, it doesn’t, kinda sorta.  There is a provision in the house bill that allows Hawai’i to opt out of the plan:

A health care overhaul bill that the House could vote on as soon as tomorrow contains language to ensure that Hawaii’s expansive health coverage requirements wouldn’t be weakened.

Specifically, provisions inserted into the almost 2,000-page bill by Hawaii’s congressional delegation would protect the state’s Prepaid Health Care Act of 1974 from any changes imposed by the new federal legislation.

The health care act requires nearly all employers in Hawaii to provide health insurance to employees who work at least 20 hours a week for four consecutive weeks.

However, it still doesn’t exempt individuals from being forced to purchase government provided health care.  Otherwise the individual could be charged with a crime of not having health insurance.  What if I can pay outright, in cash,  for any of my medical needs, doctor visits, prescription drugs or any other medical need?  What if I rather pay for my health needs when I need it?  There are people that can do that.  They make enough money to pay for any medical services with out insurance.

Equally, what about those people who are really poor and cannot afford $15,000 to pay for health care?  Hawai’i may have a progressive health care plan that forces employers to pay for their employees health care insurance, but not everyone in Hawai’i that works can afford such an expenditure.  What about the independent self-employed person?  What if the independent self-employed only makes $15,000 a year or less?  What about the elderly on fixed incomes?  At what age will forced health insurance be mandatory?  What if you are working less than 20 hours a week and struggling to get through college?

    Ye Gads, I wasn’t ready for seeing that hideous woman’s photo straightaway. But that wasn’t the worst of it: PelosiCare is going to be voted on today in Wash. DC, and the 2000-page monstrosity actually may pass.
    NOW that’s scary.
    Of course, Kini, you are right, the matter of criminal penalties for not buying health insurance is/will be Unconstitutional- AS IT SHOULD- but Liberal attorneys will keep that matter stringing along for as long as possible in the courts, until our nation is accepting of the whole crap sandwich. After that, it may be nearly impossible to reverse it all.

    It’s defeat is essential, is vital right now, before it reaches Obama’s desk, for the health of our nation as a whole.

      Aloha LMC, what’s worst is that this is NOT either about health care or insurance reform. This is about control and creating a huge government bureaucracy. I have yet to see any government program work efficiently and beneficially for the American people.

      As I watch on cable news shows this morning, the democrats bloviating over this crap sandwich they will force down our throats, I know this will kill our country as we have known it.
